1. 12.         BEHAVIOR

In order to foster a pleasant sense of community we ask everyone to be courteous and considerate of their neighbors and to respect people’s privacy in all areas of ParTerra and at all times during the day or night.

 12.1    Conduct

All residents and guests shall obey all federal, state, county and local ordinances, and fire codes while on ParTerra property at all times. No resident or guest shall engage in or permit any conduct that will interfere with the safety, rights, comforts or convenience of other residents.

 12.2    Dangerous Behavior

Any behavior or activity that may cause harm or pose a safety hazard to any person or any portion of the property is strictly prohibited. Owners shall not permit any condition to exist that will induce, breed, or harbor infectious plant diseases or noxious insects or vermin.

 12.3    Excessive Noises

Excessive noise is defined as: a disturbing sound level emanating from a unit or the Common Elements that can be heard or felt within the confines of another unit with its doors and windows closed.

 No resident or guest shall make or permit any excessive noises in the buildings, units or on the Common Elements. No owner shall permit anything to be done or kept in the owners unit, limited common elements, or common elements that would interfere with the right of quiet enjoyment of the other residents of the condominium.

 All owners, residents and guests shall keep the volume of any audio device, such as radios, stereos, televisions or musical instruments in their units, vehicles or on the Common Elements, sufficiently reduced at all times so as not to disturb other residents. In particular, sound system loud speakers shall not be rigidly attached to the party wall with another Unit or the ceilings, walls, shelves or cabinets in a Unit in a manner that will induce vibrations into the structure of the building.

 12.4    Designated Quiet Hours

No resident or guest shall operate any sound-producing devices in a unit and/or on the Common Elements between the hours of 10:00 p.m. and 8:00 a.m. on weekdays and weekends in accordance with Newcastle City Ordinance and rule 5.7. Sounds originating from residential property relating to temporary projects for maintenance or repair (example: power tools) are prohibited between the hours of 7:00 p.m. and 7:00 a.m. on weekdays, and 6:00 p.m. and 9:00 a.m. on weekends and holidays in accordance with Newcastle City Ordinance.

 12.5    Vibration

No activity within a unit which causes vibrations to travel through the floor, ceiling slabs, or drywall to another unit shall be permitted.

 12.6    Change of Occupancy

Change of occupancy is permitted only between the hours of 9:00 a.m. and 9:00 p.m. In order to cover the costs of excess trash removal, administrative costs, and cleaning associated with occupancy changes, a change of occupancy assessment is charged members each time a change in occupancy occurs, i.e. rentals, sales and other changes in occupancy. The change of occupancy assessment is $100 for studio units and $300 for all other unit types. Please provide the Office Administrator a minimum of one week notice of moving in or out so that the proper “move-kit” may be prepared.

12.7    Playing in Parking Lots

For their own safety, children are not permitted to play in the parking areas or on the streets at any time. Parents or legal guardians are responsible for the safety and behavior of their children while on the property.

 12.8    Safety

For the safety of all residents, no devices such as skateboards, rollerblades, scooters, children’s bicycles, or go-carts may be used on the streets or in parking areas.

 12.9    Firearms and Fireworks

Firearms, air rifles, slingshots, fireworks, etc., shall not be displayed or discharged in any area of the complex.
